Iphone Over Capacity Error

Hi wonder if many one can help with problem I have.



I've just bought a 2nd hand iPhone 4s (64gb).



All seemed perfect until I tried adding about 40gb of music to it when doing a back up from my old phone'a settings. It loaded most of these songs but as it got near the end it said it couldn't carry on as the phone was over capacity - impossible I thought, as it all fitted on my previous 64gb phone with out any problems!!



I then realised that my "other" items were unusually high and began to google the problem.



He first tip I found was that the back up from my old phone may have had corrupted data and that should restore from factory settings.



So, I restored from factory settings only and loaded my 40gb of music with no problems. I them realised at I had forgotten to sync my "tones" so plugged the phone back in to do this, when I was told that my phone was over capacity by 40gb!!



I've done more googling and have done the reset thing on the he phone by holding down the start and off button but nothing gets rid of the 49gb of "other" stuff.



Is this a software issue or have I got a dud phone? I've never had this problem before with any of the multiple iPhones in our household!!
